Second Hand iPhone 4 Replacement

Hi Guys,

I know this may have been asked before but, I was at work and my phone fell out of my pocket through no fault of my own. The front glass and back glass broke and my lock button is stuck now (it does not work). I know that my warranty is out of date so I will have to pay £119 to get it replaced - however I did buy the phone second hand, so will I not be able to get the replacement?
